With this customer disclosure text (“Disclosure Text”), we want to inform you about the main issues regulated in the KVKK, within the scope of our disclosure obligation regulated in Article 10 of the KVKK.

Our Purpose for Processing Your Personal Data and the Conditions Under Which Your Personal Data Is Processed

As the data controller, we process your personal data for the purposes and under the conditions stated below:

  1.  If You Visit the Stores
  • To ensure the safety of you, Kos Living, Kos Living employees, and other third parties against any acts, crimes, or behaviors likely to occur in the Stores and contrary to the applicable legislation, to provide information and documents to official/judicial institutions and fulfill other related obligations, your store security camera recordings; and 
  • If you wish to be notified when the product you want arrives at the Stores, to fulfill this request, your other personal information will be provided along with your first name, last name, phone number, and your request

  • For carrying out shopping transactions and accordingly concluding and fulfilling the sales contract, issuing invoices and tracking accounting processes, providing after-sales support services, we process your first name, last name, address, shopping details (date, time, quantity, content), and payment details (payment method and payment details), and additionally your email address, Turkish ID number and/or passport number, phone number and/or signature information to ensure the electronic delivery of the invoice related to your purchase; and 
  • If the purchase is made by credit/debit card, we process your credit/debit card information by transferring it to the relevant payment institution without being recorded by Kos Living.

When you visit the Website, it uses cookies and similar methods for statistical studies related to your usage, advertising/promotions, and to improve the customer experience on the Website. 

  1. If You Are a Website Member
  • For the purpose of completing your membership, recording your membership information, informing you about your membership, and fulfilling the membership agreement, we process your first name, last name, gender, email address, address information, mobile phone number, and log records to ensure transaction security; 
  • To provide you with the service of viewing your order history as a member, we process your shopping and payment information; 
  • To fulfill our obligation to keep your personal data provided during membership processes up to date, we process your first name, last name, gender, date of birth, email address, and mobile phone number; 
  • For offering you personalized offers based on your Website membership and purchases, creating campaigns, advantages, promotions, advertisements, organizing contests, raffles, and other events, conducting marketing, advertising, and analysis activities, carrying out communication activities, improving customer experience, and strategic planning, analysis, and business development related to operational processes, we process your first name, last name, gender, email address, mobile phone number, date of birth, city, district, and address information; and 
  • We process your approaches, habits, favorites, behaviors, preferences, search activities, past purchases, cookie records, device identity, communication preferences, purchase amount, payment methods/channels and preferences, bank information where the payment is made, brand, model, technical specifications and operating system information of the device used, operator information, survey responses regarding notifications/surveys/offers/campaigns within the Website. 
  1. When You Shop With or Without Registering on the Website
  • When you shop on the Website as a member or without membership, we process your name, surname, email address, mobile phone number, address, log records related to your shopping transaction, and your IP address to complete the shopping transaction, provide preliminary information, conclude, perform, and fulfill the distance sales contract, issue and send the invoice related to your purchase, ensure the delivery of your order to you, and provide after-sales support services; 
  • If the purchase is made by credit/bank card, we process your credit/bank card information to ensure the payment can be collected; and 
  • When you query your order using the order information and order inquiry screen, we process your email address and order number data.

  1. In Case the Purchased Product Is Sent to a Third Party
  • If you send products to third parties, we process the recipient's address, name, surname, phone number, and email address information to ensure the delivery of the order to the relevant person and to provide after-sales support services. In this case, the responsibility for informing this person(s) lies with you as the person sharing this information. 
  • In case products/gifts are sent to you by third parties, we process your address, name, surname, phone number, and email address information to ensure the delivery of the order to you and to provide after-sales support services. 
  1. If You Give Commercial Communication Consent to Kos Living Through Any Channel

If you perform your commercial communication consent transactions at Stores for the purposes of presenting general or special personalized campaigns, advantages, contests, sweepstakes, and other events conducted by Kos Living, improving customer satisfaction, conducting marketing activities through selected channels (such as SMS, email), carrying out advertising and analysis studies, and sending invitations related to invitations and other events, we process your name, surname, mobile phone number, email address, and commercial communication consent. 

  1. When You Contact Us Through Communication Channels
  • When you contact us through Communication Channels, in order to resolve your requests and complaints and to be able to contact you if necessary, to address you correctly when you contact our call center, to ensure service/transaction security, to manage, track, and report all customer relations processes, and as part of efforts to improve quality standards, we process your name, surname, social media username, email address, mobile phone number, landline phone number, legal transaction information if applicable, your requests and complaints, and other related information you provide related to your request and complaint; 
  • Our call center voice recordings to be used as evidence in our customer satisfaction efforts and in disputes that may arise between us; 
  • If your request or complaint is related to Stores, your store security camera recordings; and 
  • If you place an order or shop through the Website, in addition to these, we process your order and shopping history, invoices, and your use of points/discounts/benefits. 
  1. Legal Processes and Internal Activities
  • To ensure the safety of you and/or Kos Living and/or employees and/or other third parties against any act, crime, or behavior that is or may be contrary to the legislation, to fulfill our legal obligations arising from the legislation (including but not limited to authorized and responsible private or public institutions and organizations), to exercise all rights of lawsuit, response, and objection against official institutions and organizations such as courts, enforcement offices, arbitration boards in case of disputes, to conduct negotiation and settlement processes related to disputes, to provide you with necessary information if you request information or apply within your legal rights, to prevent use contrary to contracts and legislation, to detect suspicious transactions and unlawful uses, to carry out cancellation procedures, to perform internal audit and control as well as reporting, testing, and development activities, and to conduct studies and improvements aimed at enhancing customer experience, strategic planning, analysis, and business development related to operational processes, we process your name, surname, gender, date of birth, signature and Turkish ID number if transferred due to legal processes or present in documents sent by official authorities, mobile phone number, landline phone number, email address, address, your requests and complaints, purchases, invoices, payment information, call center voice recordings, log records if you perform transactions via the Website, IP address, security camera recordings if you perform transactions in Stores, relevant legal transaction information, and correspondence and file information related to dispute processes; and 
  • In terms of Online Visitors, we process your data through cookie records (IP address, browsing information, device used, and traffic data) to ensure information security, prevent malicious use, conduct activities in compliance with regulations, and fulfill our other legal obligations towards authorized and responsible public institutions and organizations. 

Collection of Your Personal Data 

Your personal data is collected by Kos Living, Stores, business partners, or suppliers verbally and/or in writing and/or electronically, in line with the purposes stated in Article I titled “Our Purpose of Processing Your Personal Data and Situations Where Your Personal Data is Processed” of this Disclosure Text; through security cameras and devices located in Stores; by recording the information you verbally provide to sales consultants in Stores into our systems; by recording the information you provide during your purchases through Stores and/or the Internet Site or when you register as a member on the Internet Site into our systems and your transactions through these channels; by recording all kinds of purchases, collections, deliveries, transactions, survey completions, registrations, and processes on Stores and/or the Internet Site into our systems; by recording your requests and complaints communicated to us via Communication Channels and/or Stores; by recording your calls with the call center; by automatically collecting information/documents related to you received from official institutions, organizations, and judicial/administrative authorities; and by recording your return/review process records in the relevant documents. 

Processing of Your Personal Data

Your personal data;  

  1. Within the principle of “the necessity of processing personal data belonging to the parties of the contract directly related to the establishment or performance of a contract,” regarding the establishment of Internet Site membership, fulfillment of our obligations under the membership agreement, and sales and after-sales support processes;
  1. Based on your explicit consent given in accordance with the principle of “the existence of the explicit consent of the relevant person,” regarding personal data processing processes and commercial communication activities within the scope of marketing and analysis studies related to Internet Site membership;
  1. Within the principle of “the necessity of processing data for the legitimate interests of the data controller,” regarding the detection and prevention of suspicious transactions related to Internet Site membership and the use thereof, ensuring transaction security, operational processes, and our customer relations processes;
  1. Within the principles of “the necessity of processing data for the legitimate interests of the data controller,” “the necessity of processing and transferring data for the establishment, use, or protection of rights,” and “fulfillment of a legal obligation,” regarding the processes of recording with security cameras in Stores;
  1. Within the principles of “Fulfillment of legal obligations” and “Explicitly stipulated by laws,” regarding our obligations arising from the KVKK and secondary legislation as well as applicable legislation;
  1. Within the principle of “The necessity of data processing and transfer for the establishment, use, or protection of rights,” regarding legal disputes, investigations, and other judicial/official processes; and
  1. Within the principle of “Being made public by the data subject themselves,” we collect and process data based on legal grounds. 

You can at any time and without any reason, (i) reject the process specified in the commercial electronic messages we send by marking the (opt-out) statement and thus stop the relevant commercial communication; and/or (ii) withdraw your explicit consent regarding the Website membership and terminate the relevant membership, thereby stopping the personal data processing processes based on explicit consent. 

Transfer of Your Personal Data

We transfer your personal data to third parties located domestically and/or abroad in accordance with the purposes stated in Article I titled “Our Purpose in Processing Your Personal Data and the Cases in Which Your Personal Data is Processed” of this Disclosure Text, and in compliance with the provisions regulated by the KVKK and secondary legislation. Within this framework, your personal data,

  1. Your membership, orders, or purchases are used to deliver the products you have bought or will buy, provide supply, logistics, cargo and courier services, and after-sales support services, resolve your requests and complaints, communicate with you, receive marketing/advertising/analysis/promotion activities or consultancy services, provide all kinds of information, communicate, and for promotion, sales, marketing, store card, and membership applications purposes with existing and potential companies, business partners, suppliers, and service providers within the group companies we belong to, located domestically and abroad (such as electronic communication service providers, call centers, personal data collectors via devices, marketing/advertising/analysis service providers, database and server service providers, infrastructure maintenance and support service providers, legal and financial consultancy providers, billing service providers, independent audit service providers, shipment/cargo/courier, archiving and warehousing service providers), provided that they are used within the scope of services provided by these institutions and organizations for the fulfillment of Kos Living’s activities; 
  1. To authorized and responsible private or public institutions and organizations, judicial authorities, and official institutions/organizations to fulfill our obligations to provide information and documents and other related responsibilities, and to exercise our legal rights such as lawsuits and defense rights, to the mentioned institutions, organizations, and authorities; 
  1. To our suppliers providing consultancy services and payment institutions related to the transaction for the purposes of monitoring, detecting suspicious transactions, and preventing unlawful transactions; 
  1. To our suppliers within the scope of activities aimed at increasing visitor traffic on the Website; and 
  1. If you make your payment by credit/debit card, we transfer your credit/debit card information to the relevant bank, electronic payment institution, or other third-party service providers without recording it by Kos Living.

Your Rights under the KVKK

As the owner of personal data, your rights under Article 11 of the KVKK are as follows:

  • The right to learn whether your personal data has been processed or not;
  • The right to request information if your personal data has been processed;
  • The right to learn the purpose of processing your personal data and whether it is used in accordance with its purpose;
  • The right to know the third parties to whom your personal data has been transferred domestically or abroad; the right to request correction if your personal data has been processed incompletely or incorrectly;
  • The right to request deletion or destruction of your personal data under the conditions stipulated in Article 7 of the KVKK titled “Deletion, destruction or anonymization of personal data”;
  • If your personal data has been processed incompletely or incorrectly, the right to request correction and, under the conditions stipulated in Article 7 of the KVKK titled “Deletion, destruction or anonymization of personal data,” the right to request deletion or destruction of your personal data and to request that the actions taken be notified to third parties to whom your personal data has been transferred;
  • The right to object to an outcome against you resulting solely from the analysis of your processed personal data through automated systems; and
  • In case you suffer damage due to the unlawful processing of your personal data, the right to request compensation for the damage. 

If you wish to exercise any of the rights listed here, you can submit your request to Kos Living in writing or by other methods determined by the Personal Data Protection Board, pursuant to Article 13, paragraph 1 of the KVKK. You can send your written request regarding your personal data, clearly and understandably, including your name, surname, and contact information, along with documents proving your identity, by secure electronic signature, mobile signature, or wet signature to the addresses below.
